GENERAL INFORMATION

These Terms of Service constitute the entire agreement between you and this website, found at http://www.BrentPTO.com, which is also includes use of the online calendar and your subscription to the Margaret Brent PTO mailing list, provided by Bravenet, or by PTO President. This agreement governs your use of the membership services provided, superseding any prior agreements, oral or written, if any.  Use or viewing of the Margaret Brent PTO website constitutes agreement with all stated terms and conditions, as well as any additional materials received as a result of subscriptions to the mailing list or signups for other PTO provided services, if any.  You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software, of which the Margaret Brent PTO has no authorization or control.

GENERAL DISCLAIMER

The Margaret Brent PTO website, nor its management officials, agents, or employees, does not represent or endorse the accuracy or reliability of any of the information, content or advertisements contained on, distributed through, or linked, downloaded or accessed from any of the third-party services contained on this website from any external servers, including but not limited to the server of this site, or the website component services provided by Bravenet; nor the quality of any products, information or other materials displayed, purchased, or obtained by you as a result of an advertisement or any other information or offer in or in connection with any of the third-party links provided from this site, or their advertisers. You hereby acknowledge that any reliance upon any services, materials, or products shall be at your sole risk.

INDEMNITY

You agree to indemnify and hold the Margaret Brent PTO website, and any of its management officials, its affiliates, officers, agents, other partners, and/or employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, or transmit through e-mail, private message, message board, and/or your violation of any other applicable Terms of Service, or your violation of any rights of another.

LINKS

The Margaret Brent PTO website, or other third parties, may provide links to other World Wide Web sites or resources.  Because the Margaret Brent PTO has no control over such sites and resources, you acknowledge and agree that Margaret Brent PTO, and its management officials, officers, agents, other partners, and/or employees are not responsible for the availability of such external sites or resources, does not endorse, and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Margaret Brent PTO shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

DEALINGS WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the website servers of third-parties, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that the Margaret Brent PTO shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers.

PROPRIETARY RIGHTS 

You acknowledge and agree that any service and any necessary software used in connection with either the website server, the mailing list server, website calendar, and/or photo gallery service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements, or information presented to you through the service or advertisers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and applicable laws.  Except as expressly authorized by the Margaret Brent PTO, Bravenet, or subject advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on any content appearing on the servers or related software, in whole or in part.  You agree to not (and to not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in any content, copyrighted images, or third-party software present on the Margaret Brent PTO website or related servers.  You agree not to access the Margaret Brent PTO website by any means other than through the interface that is provided by Margaret Brent PTO for use in accessing such services.

TRADEMARK AND COPYRIGHT INFORMATION

This site is for informational purposes and links to other websites are provided for reference only.  This site is not officially endorsed by any of the third-party fundraiser organizations that are linked hereto.  All related copyrighted and trademark service images of the third-party organizations are the express intellectual property of those entities, and their images may not be taken without their express, written permission and consent.   As the Margaret Brent PTO website respects the intellectual property of others, no copyright infringement is intended.  Conversely, all original images, pictures, design elements, source code, and website content displayed on the Margaret Brent PTO website are the express property of Margaret Brent Elementary School and/or the PTO.  Use of any and all original content found on said website, including, but not limited to information, images, graphics, photos, videos, and slideshows may not be used elsewhere, for personal or commercial use, without the express, written consent of the Margaret Brent PTO Board members.  For any questions, please contact the Margaret Brent PTO webmaster by clicking here.

MAILING LIST DATA COLLECTION

The Bravenet website (http://www.bravenet.com) which provides the mailing list service, does not collect any additional information beyond a name and an e-mail address.  The information is only stored on Bravenet mailing list server, and can then only be accessed by selected Margaret Brent PTO board members for mailing list purposes only.  Any data, except e-mail addresses, that the Margaret Brent PTO website collects on children under thirteen (13) years of age will be discarded in accordance with the Children’s Online Privacy Protection Act.  There is no feasible way for the Margaret Brent PTO board to ascertain whether or not an individual joining the Margaret Brent PTO mailing list is under the age of thirteen.  If that information is made known to the PTO, then special safeguards will be taken when handling that information.  E-mail addresses of children under 13 submitted during subscription to the Margaret Brent PTO website mailing list will then only be kept by the Margaret Brent PTO for identification purposes only, and under no circumstances will be displayed or made publicly available.  When ever possible, all attempts will be made to obtain parental consent.  Please click here to view the Privacy Policy for further information and important information regarding how the Margaret Brent PTO collects and maintains information on minors. The Margaret Brent PTO Board shall bear no liability for fraudulent representation of age.  In this regard, the Margaret Brent PTO shall additionally bear no liability regarding conduct by, or towards, members under the age of majority.   

TERMINATION OF ACCOUNT

Through your voluntary subscription or registration of any service provided by the Margaret Brent PTO website, you agree that the Margaret Brent PTO, in its sole discretion by and through its designated management officials, may terminate your subscription or registration (any part thereof) and remove and discard any posted content from said service(s), for any reason, including, without limitation, if designated management officials of the Margaret Brent PTO website believe that you have violated or acted inconsistently with the letter or spirit of the Margaret Brent Elementary School PTO Bylaws, the Margaret Brent PTO website Terms of Service, and/or other applicable laws or regulations.  Margaret Brent PTO may also in its sole discretion, and at any time, discontinue membership and services, or any part thereof, with or without notice. You agree that any termination of your access to use of services provided by the Margaret Brent PTO, or termination of usage of the Margaret Brent PTO mailing list, under any provision of these Terms of Service, may be effected without prior notice, and acknowledge and agree that the Margaret Brent PTO or other authorized entity may immediately deactivate or delete your membership and account and all related information and files in your account and/or bar any further access to such files.  Further, you agree that the Margaret Brent PTO shall not be liable to you or other third-parties for any termination of your access to said accounts or services. 

NOTICES:  

Notices to you may be made via either e-mail or regular mail.  Margaret Brent PTO may also provide notices of changes to these Terms of Service or other matters by displaying notices or links to notices to you generally on the Margaret Brent PTO website.  

DISCLAIMER OF WARRANTIES 

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:  

A. Your use of any of the service(s), affiliated with, or accessed via BrentPTO.com is at your sole risk.  All services provided are on an “as is” and “as available” basis.  Margaret Brent PTO expressly disclaims all warranties of any kind, whether express or implied, including, but no limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

B. Margaret Brent PTO offers NO warranty that (1) The services received through the website servers or the mailing list servers will meet your requirements; (2) Services will be uninterrupted, timely, secure, or error free; (3) The results that may be obtained from the use of the above-mentioned services will be accurate or reliable; (4) The quality of any products, services, information, or other material purchased or obtained by you through the above-mentioned services will meet your expectations; and (5) Any errors in related software will be corrected.

C.  Any material downloaded or otherwise obtained through the use of BrentPTO.com, links to external sites from the Margaret Brent PTO website, the website servers, or the mailing list servers is done at your own discretion and risk that you will be solely responsible for any civil or criminal liabilities, and/or damage to your computer system or loss of data that results from the download of any such material. 

D.  No advice or information, whether oral or written, obtained by you from the Margaret Brent PTO website management, website server representatives, and/or message board representatives, shall create any warranty not expressly stated in the Terms of Service. 

LIMITATION OF LIABILITY  

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE Margaret Brent PTO WEBSITE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE Margaret Brent PTO WEBSITE MAY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE WEBSITE SERVERS; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THIS WEBSITE OR THIRD PARTY WEBSITE SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR (v) ANY OTHER MATTER RELATING TO THE Margaret Brent PTO WEBSITE SERVICES.

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF THE ABOVE SECTIONS MAY NOT APPLY TO YOU.
